Welcome to Kipper & Co! The terms "we", "us" and "our" refer to Kipper & Co. Kipper & Co operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Kipper & Co is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

We have made every effort to provide an accurate representation of our products in our online store. However, colours or product appearance may differ slightly from how they appear on your screen due to the device you use and its settings.
All products we sell will match their description, be of satisfactory quality and be fit for purpose, as required by the Consumer Rights Act 2015.
Product descriptions may be updated from time to time. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Kipper & Co reserves the right to accept or decline your order. Your order is not accepted until Kipper & Co confirms acceptance. We must receive and process your payment before your order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will notify you using the email address, billing address and/or phone number provided at the time the order was made, and refund any payment in full.
Your purchases may be returned or cancelled in accordance with our Refund Policy (https://kipperandco.co.uk/policies/refund-policy). This does not affect your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
All prices are shown in pounds sterling (GBP) and include VAT. Shipping is free on all UK orders. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.
We may offer promotions from time to time which are governed by their own terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will apply.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made in our store, and to promptly update this information so that we can complete your transactions and contact you as needed.
You confirm that the payment card information you provide is true, correct and complete, and that you are authorised to use that card for the purchase.

SECTION 5 - SHIPPING AND DELIVERY
Delivery times are estimates and are set out in our Shipping Policy (https://kipperandco.co.uk/policies/shipping-policy). Products remain at our risk until they are delivered to you. If your order is lost or significantly delayed, please contact us and we will arrange a replacement or refund as described in our Shipping Policy.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by Kipper & Co, its affiliates or licensors and are protected by UK and international copyright and intellectual property laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on the Services without our prior written consent. All rights not expressly granted are reserved by Kipper & Co.
Kipper & Co's name, logos, product names, designs and slogans are the property of Kipper & Co. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.

Kipper & Co is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Kipper & Co. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Kipper & Co, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Kipper & Co.

If an error affects an order you have already placed, we will contact you before proceeding, and if we cancel your order you will receive a full refund.

The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. We are not responsible for any loss or damage that is not foreseeable.
We only supply products for domestic and private use. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to the products, or for defective products under the Consumer Protection Act 1987, or any other liability that cannot be limited or excluded by law.

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will continue in full force and effect.
